The Building Safety Regulator: what it means for passive fire protection

The Building Safety Regulator has changed what “compliant” means. For any higher-risk building, passive fire protection is no longer signed off by a building control inspector at the end – it’s reviewed by the BSR at defined Gateways, against evidence that has to be defensible years later. Get the evidence right and the building moves; get it wrong and the project stops.

What is the Building Safety Regulator?

The Building Safety Regulator was established under the Building Safety Act 2022 as the body overseeing the safety of higher-risk buildings in England – generally those at least 18 metres tall, or seven or more storeys, containing at least two residential units. It’s now the building control authority for those buildings, and it has real teeth: it can halt a project, refuse occupation, and pursue dutyholders who can’t demonstrate the building is safe.

 

For passive fire protection, the shift is fundamental. Compartmentation, fire stopping, fire doors, cavity barriers and structural protection are no longer just installed and inspected – they have to be evidenced, in a structured and transferable form, at the points the BSR reviews the building.

The Gateway regime

The Building Safety Act introduces three hard control points – Gateways – across a higher-risk building’s life. Each is a stop/go decision, and passive fire evidence runs through all three.

 

Gateway 1 – Planning

At the planning stage, fire safety considerations are submitted with the planning application. This is where the fire strategy starts to take shape and where early passive fire input avoids problems later.

 

Gateway 2 – Before construction

Before building work starts, the BSR reviews the design and must approve it. This is a hard stop: work cannot begin until the regulator is satisfied the design meets building regulations. Passive fire protection has to be correctly specified and coordinated here – a weak or ambiguous design creates evidence gaps that surface downstream.

 

Gateway 3 – Before occupation

Before the building can be occupied, the BSR reviews the as-built evidence – proof that what was designed is what was built, and that it performs. This is where passive fire protection is most exposed, because it depends on a complete, structured record of everything installed. Missing or reconstructed evidence is one of the most common reasons Gateway 3 stalls.

The golden thread runs through every Gateway

The evidence the BSR reviews at each Gateway is the golden thread – the structured, digital, transferable record of a building’s design and construction information. Passive fire protection is one of its largest and most detailed components. The golden thread is a distinct discipline from the BSR itself: the regulator is the front door; the golden thread is the evidence you bring to it.

The 30-year reach: why records you never kept still matter

The Building Safety Act didn’t just change how new buildings are approved – it reached backwards. The Act extended the limitation period under the Defective Premises Act 1972 to 30 years for work completed before it came into force, and 15 years for work after. In practice, that means building owners can pursue claims for defective building work going back three decades.

 

For passive fire protection, the consequence is stark: firms are being required to revisit historic projects, and those that never kept a proper record of what they installed have no way to defend the work. Some have not survived it. It’s the clearest possible argument for evidence-led delivery – the record you build today is the defence you’ll rely on for thirty years.
